The US military detention facility at Guantanamo Bay, Cuba, is legal and approved Law of War incarceration for unlawful combatants in the Global War on Terror. Even lawful combatant POWs may be held without charge or trial “until the end of hostilities,” in accordance with the Geneva Conventions and Law of War. “Palestinian” or other unlawful combatants held by Israel are likewise not entitled to the protections or privileges of the Geneva Conventions or Law of War because they are unlawful combatants. Lawful combatants carry arms openly, wear uniforms, are members of a command structure and their country is a signator to the Geneva Conventions.
