It’s the court that is weak, but then the membership has been loaded purposefully over the years to reach an anti-Israel conclusion. The underlying premise of the South African case is that there are no Palestinian combatants, and that Israel is not pursuing valid military goals,. Both of these assertions are patently false.
Have you listened to the whole set of hearings or read the transcripts? I’m only about a third of the way through but thus far South Africa’s “case” consists of thinly disguised propaganda cribbed off the internet. It’s largely based on twisted half quotes where Israelis have called for the elimination of Hamas and the lawyers for the prosecution falsely claim that this means all Palestinians. It’s based on half baked figures from the Hamas “Ministry of Health” which hides militant casualties amongst civilians, fails to acknowledge the presence of militant assets nor admit Hamas’s own culpability, whether its their own firing on civilians to prevent them from fleeing or failing to provide shelter, leaving such things up to Allah and the Israelis.
Israel’s defense is that it has done more to protect civilians than any other modern army in a military situation. It could have ended this war on Oct 8. Instead it held back invading Gaza for over a week to give time for people in the north safely evacuate to the south.
The situation is very much like that of Jenin in 2002. There the PA announced that there were 500 Palestinian deaths, mostly civilians, and the UN and MSM simply repeated what they were told. The actual casualties were 1/10th as much, and most were combatants.
The Israelis are estimating 8,500-9,000 Palestinian combatants have died. Some of these are children who have joined in the fighting. Educated to aspire towards martyrdom and kill Jews since kindergarten, how could they not be? Same mentality going on with the mujahadin in Yemen.
