To clarify, it is not a prisoner exchange. Hamas wants prisoners with blood on their hands in exchange for innocent hostages.
Article 147 of the 1949 Geneva Convention IV identifies hostage-taking as a “grave breach”, a status that imposes obligations to provide effective penal sanctions for the offense and to search for and prosecute offenders- (Article 146)
The ICJ recognized months ago that Hamas launched the war with its October 7 attack and called for the “immediate and unconditional release” of all Israeli hostages. Israel did not go to the ICJ for this statement, why has Hamas not complied?
