This should have been a decision and outcome of the two cases at the ICJ, as a binding International order to become law, without some, who are aiding and abetting crimes against humanity, mass atrocities and some of the most genocidal warfares in the last decades, so are the brutality of terrorising guerilla tactics of operations like Oct.7 by Gazan palastinian armed groups like Hamas and others, who breached the border fences, and conducted a deadly attack in the Gaza Envelope against military bases, the command centres and HQ’s of the military and intelligence Division with responsibility of the Gazan Envelope and civilian society, living close to the border fence in the region, in Kibutzim.
All warcrimes, crimes against humanity, mass atrocities and genocidal warfare tactics, should never get away, by not applying: Precaution, distinctions
(between combatant and non-combatants) and proportionality, while conducting military operations and if there is deliberately unproportional harm and suffering of the civilian population inflicted in a war, which could have been preventable harm, inflicted by hateful racist/fascist or ideological genocidal intent, no matter which party is the perpetrator of the mass atrocities against civilians and the deliberate destruction of critical infrastructure, needed for the surviveability and the integrity of the Civilian Society to their very safety of existence.
Healthcare, Food, Water and Electricity should even never be used to starve and deprive a group of the basic necessities to their survivability and as a weapon of war against them.
Perpetrators of grave violations of crimes against humanity, mass atrocities, deliberately killing of unarmed civilians, aid-workers, healthcare-providers, human right’s NGO’s, food distributions and their personell and Journalists should never be an acceptable form of conducting a warfare!
These are preventable harms inflicted to a civilian Society, with the intent to kill and destroy a group in part or full, which should never happen with impunity and without accountability!
These absolute disrespect of human lifes and humanity, deliberate by hatred or willingly to inflict harm, which brings conditions to the lifes of civilian society, which threatens their very existence, should be punished and perpetrators held to account, automatically by Universal Jurisdiction, as binding Order ruled by the ICJ to Law for all Member-States to be applied and “Justice guaranteed for the Victims” in this case, whether of Hamas or the IDF, with their racist/fascist hatred and genocidal intent, of the harm inflicted, against the Gazan Palastinians as a group! Not every collateral damage is preventable harm of civilians and civilian infrastructure but there are enough killings and destructions, done by this warfare which shouldn’t have unfolded and been conducted in a way of these mass atrocities and deliberately deprive and destroying the whole Gazan palastinian critical civilian infrastructure needed for the very existence for the liveability and integrity of the Gazan civilian society, that is a genocidal warfare and should be punished as such.
The fighters of the armed groups, which conducted raids with mass atrocities, on civilian societies in Israeli Kibutzim, the Music Festival or other parts of civilian society, also the torture or killing of POW, which the captured are becoming, after they were taken hostage, as same as mass detentions, of mostly unarmed palastinians like medical staff, patients and their families or sheltering civilian groups, are by capturing, detention or interrogation treated as unarmed civilians and POW, they should be treated humanly and every violations of extrajudicial killing or torture should be prosecuted as warcrime, the perpetrators held to account without excuse or impunity, if mass atrocities of civilians killed deliberately occur, than there is a whole command chain to bring to Justice and hold to account.
Such things should happen automatically, to avoid such cases of security council granted impunity, which is a grave betrayal, to every efforts of the UN-Charter, Rome Statute, the Geneva Conventions, International humanitarian law, the Universal declaration of human Rights!

Universal Jurisdiction, by all Member States of the UN, should be the normal automatically applied Order by the ICJ, if these mass violations of the commitments by the UN-Charter occur in a systematic abuse if the rules, norms, geneva conventions and laws to prevent civilian harm!
