The President of the ICJ, Joan Donoghue, made a recent statement that the ICJ only determined that South Africa had a plausible right to put forward a case. It also ruled that Israel could continue its war against Hamas. The only legal ruling of consequence that it made was the Hamas had to return the hostages immediately and unconditionally, which, being the criminal organization that they are, they, MEMO and you seem to have entirely missed.
If the ICJ were to make a prior determination of the outcome it would be a travesty of justice comparable to the worst excesses of Communist Russia. Even the Dominican Republic is not that corrupt, yet.
The flaw in the case is the pretense that Hamas & PIJ don’t have militias and that all of the casualties in Gaza are civilians. They dishonestly hide their losses in civilian statistics just as they cowardly hide amongst civilians leading to a lopsided and totally false conclusion. And In the last few days Hamas has fired rockets at both the Keren Shalom and Rafah crossings shutting them down temporarily. The myth that Hamas is just harmless bunch of civilians has been busted time and again and only fools would take it seriously.
